Please read these Terms & Conditions carefully before purchasing. By purchasing tickets, completing a Booking Form, or attending a raceday you are agreeing to be bound by the following Terms & Conditions.
Counties Racing Club Inc. is a NZ Registered Club.
Our motor racing divisions legal business name is PUKEKOHE PARK LIMITED.
Our function center divisions legal business name is COUNTIES FUNCTION CENTRE.
Pukekohe Park – the venue.
CRC – Counties Racing Club Inc. including Pukekohe Park Limited including Pukekohe Park Event Centre.
Tickets and Hospitality Packages – admission tickets to public areas, Members Grandstand, products such as bar tabs and with defined hospitality packages such as the Oaks Lounge, Racing Village areas including Daniel Le Brun marquee and private Mini Marquees, Colts & Fillies, Running Rail Picnic Sites or such other packages, rooms, events or products as defined by CRC.
2.1 A binding agreement between CRC and the Client is effective upon CRC receiving a properly completed Booking Form and the Client meeting the payment terms as required.
2.2 Bookings are subject to the availability of the requested facility, and will not be reserved or confirmed until receipt of a properly completed Booking Form, and full payment is received in accordance with these Terms & Conditions.
2.3 No cancellation or termination of the agreement by the Client will be accepted by CRC after a completed Booking Form, and payment, has been received. CRC will not issue any refund for any part or full payment under any circumstance.
3.1 All bookings for Tickets and Hospitality Packages must be accompanied by full payment in the form of a cheque, direct credit, cash or by credit card.
3.2 Failure to pay for any Tickets and Hospitality Packages entitles CRC to cancel the booking. If a booking is cancelled by the Client, all payments previously made by the client to CRC are forfeited by the Client. CRC will not issue any refunds for either the part payment, or full payment, under any circumstance whatsoever.
3.3 GST will apply to all goods and services supplied where applicable. Prices are in New Zealand dollars and include GST unless otherwise stated.
(a) Packages inclusive of beverages – CRC accepts no responsibility for late arrivals, and the package duration may not be extended beyond the stipulated time, under any circumstances. The Client must provide credit card details, or cash, for payment of beverages consumed past the stipulated time.
(b) Packages not inclusive of beverages - The Client must provide credit card details for payment of beverages on consumption, or pay cash, for beverages when purchased.
4.0 Use of facilities
4.1 The serving and consumption of alcohol is subject to Liquor Licensing laws including the Sale and Supply of Alcohol Act 2012, and its requirements.
4.2 Pukekohe Park is now a fully licensed venue. "BYO” alcohol is no longer permitted in any areas, including in the picnic areas or carparks.
4.3 A dress code applies to all hospitality areas and events on course, and is strictly enforced. Anyone not adhering to the dress code will not gain entry into hospitality areas/events.
4.4 Promotional photographs and film footage are taken on Raceday or at any event held at Pukekohe Park. By entering Pukekohe Park you are deemed to be consenting to the use of your image being used by Pukekohe Park, its agents and subcontractors, and the New Zealand Racing Board, for promotional purposes.
4.5 CRC, and its approved contractors, accept no responsibility for security of goods supplied by the client in private facilities.
5.0 Facility signage
5.1 Subject to the prior approval of CRC, which may be withheld at its sole discretion, limited company signage, including umbrellas, may be permitted on the external areas around marquees or rooms. Company signage may also be permitted within the marquees or rooms. Any signage must be approved by CRC ten (10) business days prior to the event in question.
5.2 Company signage is not permitted in any general or shared room facility.
6.0 Issue of tickets
6.1 Tickets will be forwarded by post upon receipt of full payment by your preferred mailing type. For payments received within seven (7) days of the event, tickets will not be posted, you will need to collect tickets from the Pukekohe Park reception between 8.30am – 4.30pm Monday to Friday, excluding public holidays, or on the day of the event, at the Administration Office.
6.2 A unique reference number identifies your purchase. This unique reference number, along with suitable photographic identification, will be required to collect your tickets. Only the credit card holder/owner is authorised to purchase tickets online and subsequently only that person may uplift tickets designated for collection at the venue. The credit card used for making the booking will also be required for identification purposes.
6.3 The issue of tickets to a particular facility, or event, does not permit entry to any other private or restricted facility. However, access is permitted to all public areas.
6.4 CRC will not accept responsibility for misplaced, lost or stolen tickets previously issued. Any replacement tickets will be issued at the sole discretion of CRC; CRC reserves the right to charge for the replacement of any tickets issued.
7.0 Display of tickets
7.1 Correct ticketing must be displayed at all times and/or on request. Failure to comply will result in entry being refused, or removal from the venue.
8.0 Conditions of entry
8.1 Admission to an event is subject to CRC’s Terms and Conditions.
8.2 CRC has the right to deny entry into, or remove ticket holders from, an event where CRC has reasonable grounds to do so, including any breach of these Terms and Conditions, including, but not limited to, intoxication, being under the influence of illicit drugs, being inappropriately attired or if you are deemed by CRC management to be adversely affecting the enjoyment of the event by others.
8.3 You may be required to consent to a search of your person and/or possessions before entering the event, and an identification check at any time. Any refusal may see you refused entry to Pukekohe Park, or any facility or area within Pukekohe Park, or may require you to leave Pukekoke Park. No refund of any part of any ticketed event or activity will apply.
8.4 Entry to an event may be refused if the authenticity or validity of a ticket is questionable, including because the ticket has been damaged or defaced in any way, or has not been purchased from CRC directly.
9.1 The on selling of tickets for gain is not permitted. Clients are not permitted to sell or on sell for gain any part of their Tickets, or Hospitality Packages. Any form of advertising or promoting of such is deemed to be on selling. Any Client who offers to on sell, or is deemed to be on-selling for gain will have their booking cancelled.
9.2 Clients are entitled to share the cost of entertainment with their guests, however if the Client is operating to earn a profit, they are deemed to be on selling.
9.3 Tickets may be limited for a particular event when purchasing. This includes orders associated with the same name, email address, billing address, credit card number or other information. Ticket limits apply to ensure fair access to tickets for the general public and as a measure to minimise ticket scalping.
10.1 All Clients release, and indemnify CRC from, and against, liability for any claims, demands, actions, suits or proceedings, costs, expenses, losses, damages arising out of or otherwise in connection with use of the tickets or any facilities to which the tickets relate by the ticket-holder or his or her agents, employees invitees and/or guests.
11.0 Alterations to the Raceday
11.1 Some venues are outdoors. In such cases, no alternative facilities may be available in the event of unfavourable weather. No refunds, or part refunds, will be entertained in any circumstance where alternative facilities are available. CRC will endeavour, wherever possible, to find suitable alternative facilities.
11.2 If any part of a Raceday, or event held at Pukekohe Park, including, without limitation, a race meeting, any race, performance or event is cancelled, abandoned or postponed, in whole or in part, due to adverse weather or for any other reason whatsoever that is beyond CRC’s control, including, without limitation, due to adverse weather conditions, there is no right to refund or exchange and no obligation is assumed by CRC for the arrangement of a substitute event, performance or any other element.
11.3 Due to unforeseen circumstances it may be necessary for CRC to reschedule a Raceday or event, or relocate the Raceday or event to an alternative racetrack or event facility within 100 kilometres of Pukekohe Park; if CRC does so, CRC will use its reasonable endeavours to provide, on the rescheduled day, a comparable facility to the Client. If CRC does provide a comparable facility on the rescheduled day the Client is bound to accept that facility and these terms and conditions will apply in all respects.
11.4 Programmes, menus and the duration, and timing of performances, events and other activities at a Raceday or event may be subject to alteration without notice. CRC reserves the right to vary, add, withdraw or substitute advertised programmes, menus, seating arrangements and/or facilities at any time.
11.5 Under no circumstances will CRC be liable to the Client if CRC is unable to perform its obligations to the Client due to any event or cause of force majeure being any event or act beyond the control of CRC.
12.1 All representations and warranties, whether expressed or implied are excluded to the maximum extent permitted by law.
12.2 This contract is governed by and construed in accordance with New Zealand law and customers agree to submit to the exclusive jurisdiction of the courts of New Zealand.
12.3 Contact details provided when purchasing tickets and hospitality packages can be used by CRC, it’s agents, partners and contractors, and be provided to the New Zealand Racing Board for promotional, marketing and research purposes.
12.4 CRC has the right to vary these Terms and Conditions at any time by updating them. Any variations will only apply to ticket purchases made after these Terms and Conditions have been updated.
13. Responsible Service of Alcohol
13.1 The management and staff of CRC believe that we have a responsibility to provide an environment that is not only comfortable and welcoming, but is also where alcohol is served responsibly. With this in mind the following Host Responsibility policy has been implemented.
COUNTIES FUNCTION CENTRE HOST RESPONSIBILITY POLICY
We provide and actively promote a range of non-alcoholic beverages.
Counties Function Centre (CFC) recognizes that it is against the law to serve anyone to intoxication.
All bars have readily available low alcohol beer and wine, fruit juice, soft drinks, tea and coffee. Water is easily accessible and free of charge, at all times. CFC does not seek to encourage rapid or excessive consumption through pricing or packages.
In support of our responsible attitude to alcohol service, catering will be readily available at all times and staff will actively promote the catering option/s. Menus are designed to complement the particular event and/or function.
CFC recognizes that it is against the law to serve anyone under the age of 18. If there is any doubt as to someone’s age, identification will be checked. Acceptable forms of ID are- Current Photo New Zealand Drivers License, HANZ 18+ card & Current passport. If a person is less than 18 years of age or refuses to produce identification, staff will refuse service and advise a supervisor of the patron.
Patrons who are intoxicated will be refused admission to our premises.
CFC staff are trained to recognize signs of intoxication, and deliver practical interventions. CFC seeks to publicise and promote its position on Responsible Serving Practices and will not have promotions that encourage intoxication or excessive consumption of alcohol.
Staff are instructed to offer alternative beverage options and promote food consumption to patrons they suspect are becoming intoxicated as a responsible host intervention process. Guests identified as intoxicated will be denied service, and asked to leave the premise. If a guest is asked to leave due to intoxication, safe transport options will be offered.
We expect all patrons to conduct themselves in an orderly, respectful and proper manner at all times. Counties Function Centre recognizes that it is against the law to allow disruptive or violent behaviour to occur on the premise. If we are aware that a persons behavior is becoming disruptive or violent, the person will be addressed. If the behavior is not rectified the person will be asked to leave the premises and encouraged to utilise the safe transport options available.
We promote the use of alternative transport options. We are pro-active in seeking to discourage drinking and driving. We are happy to arrange alternative transport, such as United Taxis 09 295- 1000/ 0800-66-00-44 or Dial a Driver Service 09 236-9568/ 027 292-2363.
Host responsibility makes sure that everyone has a good time and most importantly leaves you in a safe shape for the trip home.
14.1 CRC will ensure all information gathered on its, or Pukekohe Park’s, website will be used in accordance with the New Zealand Privacy Act.
14.2 Personal information collected from online booking and ticket sales will be retained by Pukekohe Park in its database. You have the right under the Privacy Act 1993 to access any personal information held about you and to correct or delete such information from the CRC and Pukekohe Park database.
Payments are processed through the secure DPS Payment Express system. Any credit card details stored for payments are done so on the DPS system. No credit card information is stored by us. DPS is PCI compliant and handle the security of your card details. Payments must be received prior to orders being shipped.
